Resumen
The authors analyze the freedom of information from a general theory of fundamental rights. They sustain, in opposition to the opinion of the Chilean Constitutional Court, that this right cannot be understood as "implicit", but as a fundamental norm ascribed to the Constitution. Considered as a fundamental norm, every constitutional effects and consequences should be applied to the freedom of information. Finally, the authors critically review the new freedom of information law´s, transparency focused primarily on National Defence issues.
