Resumen

The purpose of this article is to analyze the Italian experience of the beni comuni - particularly the urban commons - and its possible transposition in Chile within the framework of the current constituent process. The methodology used is theoretical, dogmatic and practical. First, a range of doctrinal approaches to the notion of common goods is presented; second, the normative and practical experiences of the Italian urban common goods of Naples and the Labsus model are presented, and then the impact on the notion of public domain and, more generally, on the social function of property is reflected upon. The relevance of the study has to do with the fact that the debates around the project of a new constitution for Chile offer the opportunity for the implementation of this new category of goods at the communal level and allows concluding that it would reinforce the autonomy and legitimacy of the Chilean municipalities that seem to be weakened to the detriment of the regions by the consecration of a supposed regional State.
