Abstract

The purpose of this article is to analyze the possibility of treating the conflict of abortion from a perspective that is more restorative than the current punitive approach given by the legal system in Chile, problematizing the issue from a social conflict approach, facing the challenge that will arise Chilean society to legislate on abortion without grounds, limited only to a system of terms.in the face of the challenge that Chilean society will face to legislate on abortion without cause, limited only to a system of deadlines. For what will be used a qualitative methodology, descriptive and exploratory design. Supported by the critical analysis of the discourse and whose object of study were legal texts, studies alluding to abortion and comparative experience. Concluding that it is necessary to grant a restorative response to this social phenomenon, in cases where the causes allowed by law do not concur, instead of applying a punitive sanction, which historically has led to aggravate its consequences or its decriminalization. absolute without preventions other than those of time, which makes this social conflict invisible, allowing a more restorative and preventive solution to abortion.
