Abstract
This work focuses on the problem of the democratic legitimacy of judicial balancing, analysing the theoretical debate between Robert Alexy, Jürgen Habermas and Luigi Ferrajoli. We aim to pinpoint how this issue leads to various solutions depending on different understandings of the distinction between rules and principles, and more in general of the function of the law in today’s constitutional democracies.
